
DELTA APC DISOWNS AND REJECTS FAKE LETTER ALLEGEDLY ISSUED BY THE NATIONAL LEGAL ADVISER PURPORTING TO DIRECT REINSTATEMENT OF ETHIOPE WEST LGA OFFICIALS
The attention of the All Progressives Congress (APC), Delta State, under the chairmanship of Elder Omeni Sobotie, has been drawn to a fake letter and an accompanying internal memo presently circulating within party circles and in the public domain. The said documents are alleged to have emanated from the Office of the National Legal Adviser of the Party, Murtala Aliyu Kankia, Esq., and purport to direct the Delta State Chairman of the APC to reinstate the removed Chairman of APC Ethiope West Local Government Area, Mr. Efe Amughoro, and his Vice Chairman, following an alleged “legal opinion” on disciplinary issues in Ethiope West LGA.
Delta State APC finds it necessary to issue this press statement in order to clearly, firmly and unequivocally debunk, repudiate and distance the Party from the said letter, which is strange in content, procedurally defective, constitutionally untenable, and wholly inconsistent with the established decision-making framework of the All Progressives Congress.
It must be clearly stated that while the National Legal Adviser is constitutionally empowered to render legal opinions when requested, it strange and concerning for him to convert such advice or opinion into enforceable directives or binding orders as contained in the purported letter, without the imprimatur or approval of the National Working Committee (NWC), as doing so would amount to constituting himself as the judge and executioner at the same time.
Furthermore, it must be emphasized that disciplinary matters and disputes arising from Local Government or State Party structures fall within the collective jurisdiction of the National Working Committee (NWC), acting in accordance with laid-down constitutional procedures. Only the NWC, through a duly convened meeting and a formal resolution, can lawfully review, affirm, vary, or set aside disciplinary actions taken at any level of the Party.
The purported letter under reference makes no mention of any NWC meeting, deliberation, or resolution authorizing the alleged directive. In the absence of such approval, the said document remains null, void, of no effect, and incapable of creating any legal or administrative obligation on the Delta State APC.
Delta State APC therefore views the circulation of this document as a deliberate attempt to mislead party members, cause confusion within the Party, undermine the authority of constitutionally recognized organs and destabilize the existing party structure in Ethiope West Local Government Area.
Consequently, Delta APC categorically disowns, disclaims and rejects the said letter in its entirety and calls on all party members, stakeholders, security agencies and the general public to ignore it completely, as it does not represent the official position, decision, or directive of the national leadership of the All Progressives Congress.
Delta APC remains resolute in its commitment to the rule of law, internal democracy, constitutional supremacy and due process in the administration of party affairs. All members are urged to remain calm, law-abiding and loyal to the Party’s constitutionally established leadership and structures as presently constituted in Ethiope West LGA.
