The Federal High Court has today, 20 July 2026, restored Ughelli South State Constituency II and ordered the Independent National Electoral Commission (INEC) to conduct elections into the constituency during the forthcoming general elections.
This landmark judgment is a significant victory for the people of Ughelli South, and by extension the entire Delta Central, reaffirming their constitutional right to effective legislative representation in the Delta State House of Assembly.
It will be recalled that this victory is part of a long-standing legal battle to restore four state constituencies in Delta Central Senatorial District that have remained suppressed since 1991 by the defunct National Electoral Commission (NEC).
These constituencies are:
- Sapele Constituency II- Restored on June 10th, 2026
- Ughelli South Constituency II- Restored today, July 20th, 2026
- Ethiope East Constituency II
- Ethiope West Constituency
Today’s judgment restoring Ughelli South Constituency II marks yet another major milestone in the quest to meet the constitutional requirements of Sections 91 and 112 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), and to restore the full representative quota of the Urhobo people in the Delta State House of Assembly.
At 29 members, the Delta State House of Assembly as currently constituted suffers a shortfall because the Constitution provides for a 30 member minimum and 40 member maximum.
This judgment further strengthens the rule of law and reinforces the constitutional guarantee that every qualified constituency is entitled to fair and effective representation.
We remain unwavering in our commitment to pursuing the constitutional rights, equitable representation, and overall welfare of our people until justice is fully achieved for all the affected constituencies.
